Any successful partnership needs to start with trust. For this reason, and countless others, we take the privacy of your data seriously. 

This Privacy Policy explains how Earlybird Early Learning Inc., the provider of the Earlybird platforms (“Earlybird”, “we”,  “us”, or “our”) collects, uses, and discloses information about you when you access or use our websites (the “Site(s)”), mobile applications (“Apps”), and other online products and services provided therein (collectively, the “Service”), and when you contact our customer service team, engage with us on social media, or otherwise interact with us. It also explains the choices you have regarding such use and disclosure, and how you may correct that information. This privacy policy has been prepared to meet the rules for the collection and use of personal information set out in British Columbia’s Personal Information Protection Act (“PIPA”).

Before using the Service or submitting any personal data to Earlybird, please review this Privacy Policy carefully and contact us if you have any questions. By using the Service, you agree to the practices described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not access the Site, Apps or otherwise use the Service.

The Data We May Collect

The data that we may collect from you includes the following: your personal details, including but not limited to your name, your email address, names of your children and their age and other information you choose to share (all such personal or identifying details, your “Personal Information”); the type of device you are using to access our website or app; the internet service provider you are using; records of your consents; purchase details; information about your interactions with our content, app usage, or behaviors; and any views or opinions you provide to us.

In addition, our Site or Apps may use cookies, log files and web beacons to collect information regarding  your use of our Services including your interactions with content on the Services, for the purpose of evaluating the use and operation of the Site or Apps. Generally this information is non-identifiable and would not be considered Personal Information within the meaning of PIPA.

How We Collect or Create Data

We may collect User Information about you from the following sources:

  • Data you provide: We may obtain Personal Information about you when you provide it to us across our Site or Apps to access the Services (e.g., where you sign up for emails or newsletters; register for site membership, or create a profile or account on any part of the Services; enter sweepstakes, contest, competition or prize draw; participate in surveys and quizzes; perform search queries through the Site or Apps; contact us via email, telephone or by any other means; make a purchase; etc.).
  • Data you provide: We may obtain Personal Information about you when you provide it to us across our Site or Apps to access the Services (e.g., where you sign up for emails or newsletters; register for site membership, or create a profile or account on any part of the Services; enter sweepstakes, contest, competition or prize draw; participate in surveys and quizzes; perform search queries through the Site or Apps; contact us via email, telephone or by any other means; make a purchase; etc.).
  • Relationship data: We may collect or obtain your Personal Information in the ordinary course of our relationship with you (e.g., if you purchase a service from us).
  • Service data: We may collect or obtain your Personal Information when you visit, download, use or register to use any part of our Service.
  • Content and advertising information: If you choose to interact with any third-party content or advertising on the Site or Apps, we may receive User Information about you from the relevant third party.
  • Third-party information: We may collect or obtain your Personal Information from third parties who provide it to us. This may include offline channels such as through telephone or direct mail efforts; from customers, vendors, suppliers, third parties, commercially available or publicly available sources (e.g., data brokers, data aggregators, public databases, etc.); third party affiliate network operators; referral sources; and social network sites or services (e.g., Facebook, Twitter, LinkedIn, etc.). If you use a third party connection or log-in (e.g., Facebook Connect, Twitter, or Google+) to access the Services, create a membership or profile on any part of the Services, access our content or forward our content to another person, platform or service, we may also receive your username or email address for those third party services or other information. This Privacy Policy does not cover the practices of such third parties who may provide information about you to Earlybird.

Purposes for Which We May Use and Process Your Information

The purposes for which we may use and process your Personal Information, subject to applicable law, include to:

  • Provide the Services to you, as well as to provide general information and materials referenced on our Site or within our Apps;
  • Personalize the Services by showing you content relevant to your children, their development, and your parenting journey,
  • Send you advertising and marketing communications
  • Provide support and troubleshooting
  • Send you email and push notification communications about the Services
  • Provide security for the Services and obtain analytics about app and ad performance
  • Market, develop, and improve our products and services
  • Conduct clinical and scientific research, subject to your informed consent where required by law
  • Create deidentified data and aggregated data and statistics about the use of the Services
  • Ensure compliance with our Terms of Service and ensure the security of our systems, including conducting investigations where necessary
  • To the extent you receive advertising and marketing communications from us, you may opt-out of such communications by following the opt-out instructions contained in the e-mail. Please note that it may take up to 5 business days for us to process opt-out requests. If you opt-out of receiving e-mails about recommendations or other information we think may interest you, we may still send you e-mails about your account or the Platform Services. You may contact our Privacy Officer as indicated in the “Contact” section below if you have any questions.

Purposes for Which We May Share Your Information

Earlybird may provide Personal Information to our business partners with whom we jointly offer products or services, or whose products or services we believe may interest you. Earlybird requires our business partners to agree in writing to maintain the confidentiality and security of any Personal Information we provide to them and not to use it for any purpose other than the purpose for which Earlybird provided such information to them.

Further, Earlybird may access, preserve and disclose your Personal Information and Content if required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary to: (a) comply with legal process nationally or internationally; (b) enforce our Terms of Use; (c) protect the rights, property or personal safety of Earlybird, its Members and the public; or (f) otherwise as pursuant to the terms of this Privacy Policy.

Consent to Collection, Use & Disclosure of Personal Information

We generally obtain your consent prior to collecting, and in any case, prior to using or disclosing any Personal Information for any purpose. You may provide your express consent to us either electronically, orally or in writing. You may also consent to Earlybird’s collection, use and disclosure of Personal Information by voluntarily providing us with Personal Information through a clear, affirmative action (e.g. by signing up for a mailing list, participating in a survey, etc.). We may also rely on your implied consent to the collection, use and disclosure of your Personal Information where implied consent is permitted under applicable law.

Subject to certain exceptions, users can withhold or withdraw their consent to the use of Personal Information. For example, if you have agreed to receive marketing communications, you may always opt out at a later date. If you no longer wish to be contacted for marketing purposes, please contact our Privacy Officer (see the “Contact” section below). Please note, however, that withdrawing consent may affect your ability to access and use the Site, the Apps or the Services. 

Some areas or features of our Site, Apps and third-party sites you may be directed to (such as forums, groups or events) may permit you to voluntarily disclose other Personal Information. Users should be aware that when they voluntarily disclose personal information (e.g., name, e-mail address, phone number) in these areas, that information can be collected and used by others and may result in unsolicited messages from other people. You are responsible for the personal information you choose to submit in these instances. Please take care when using these features.

Updating and Accessing Personal Information

You may ask for access to any information that we hold about you. You may also ask how we collect that information, how we are using it and to whom we have disclosed it. Your request for access must be in writing and should be sent to hello@learnwithearlybird.com. We will acknowledge your request in writing and may request that you provide us with information to allow us to confirm your identity before providing you with the information that you have requested. 

Access will generally be provided free of charge, however, if you request that information be copied or transmitted, we may charge a reasonable fee (which you will be notified of in advance and be given the opportunity to amend or withdraw your request). We will provide you with access to your information without 30 days of our receipt of your request, or provide written notice that additional time is required to comply with your request. 

In some circumstances we may be unable to provide access to some or all of the information we hold about you. If we are unable or not permitted by law to provide you with access, we will provide you with an explanation and indicate further steps which are available to you.

You may submit written requests to us to correct errors or omissions in your personal information that is in our custody or control. If your request is reasonable, we will correct the information and send it to any organization the information was disclosed to during the year before the date the correction was made. If we are not satisfied that your request is reasonable, we will annotate the information noting that a correction was requested but not made.

Links to Third-Party Websites

There may be links to other websites on the Site or in our Apps, but the inclusion of these links does not represent our endorsement, authorization or affiliation with the other websites. This Privacy Policy and our Terms of Service do not cover any third-party websites. You should consult the terms and conditions of any third-party websites to understand their privacy policies and how they collect and use your information. Earlybird is not responsible for the content or practices of third-party websites that may be linked to the Site or the App.

Security

You use the Service at your own risk. We implement commercially reasonable technical, administrative, and organizational measures to protect Personal Data both online and offline from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no Internet or e-mail transmission is ever fully secure or error-free. In particular, e-mail sent to or from us may not be secure. Therefore, you should take special care in deciding what information you send to us via the Service or e-mail. Please keep this in mind when disclosing any Personal Data to Earlybird via the Internet. In addition, we are not responsible for circumvention of any privacy settings or security measures contained on the Service, or third-party websites. 

International Users

Earlybird is based in Canada and processes information in Canada, which may not provide equivalent levels of data protection as your home jurisdiction.

Changes to this Privacy Policy

Earlybird keeps its privacy policy under regular review and reserves the right to change this Privacy Policy from time to time without notice. We encourage you to review the Privacy Policy whenever you access the Service or otherwise interact with us to stay informed about our information practices and the choices available to you.
